Terms and conditions
Welcome to Capsule Rent! These Terms and conditions (“Terms”) are between you (“you” or “your”) and Capsule Rent e.U. (“we,” “our,” “us,” or “Capsule Rent”), and regulates your access to and use of our website located at capsule-rent.com (the “Site”), and related services, including Capsule Rent’s product rental and sale services (together with the Site, the App, and the Content (as defined below), the “Services”). These Terms also apply to in-person rentals and sales, which are part of the Services.
By using any of the Services, including by creating an Account (as defined below), you acknowledge that you have read and understood these Terms. The following Terms shall apply between you and Capsule Rent:
1. Definitions
“Capsule Rent” means Alexandra Demidova, sole proprietor, with business address Zelda Kaplan Weg 6/28, 1100, Vienna, Austria.
“The client” means any person, body of persons, or company with whom Capsule Rent enters a contract for the use of services.
“Item” is every piece of clothing or accessory rented by Capsule Rent. All items are second-hand items and might contain insignificant traces from previous use.
“Ordinary use” means the use of an item in accordance with normal commercial customs, its purpose, and in accordance with manufacturer recommendations and/or instructions in the materials and documentation for the said item.
“Ready-to-use” means that the item has been cleaned and has no damages that prevent its ordinary use.
“Emergency cleaning” means that the item cannot be used for its ordinary use until it is cleaned and the lack of immediate cleaning would result to damages that exceed small repairs.
“Small repairs” means repairs of damages of the rented items, caused by ordinary use, such as open seams, a lost button, removable stains, etc. These damages do not make the item unusable. The assessment of whether the damage can be fixed with a small repair is done by a professional tailor whose services Capsule rent is using.
“Damaged item” is every item that upon the use of the client is damaged in a way that prevents its ordinary use. That is any damage that cannot be fixed by a small repair. “Clean tag” is an attachment every item is delivered with to the client. Removing the tag equals using the item. The clean tag can be only attached by Capsule Rent.
“Rental price” is displayed on the website price the client pays for the item.
“Retail price” is the price the item was sold for in retail at the item Capsule Rent has purchased it. The retail price is displayed on the website.
2. Applicability and scope of the Terms and Conditions
The following Terms and Conditions apply to all cases when Capsule Rent provides a service for the client.
By placing an order, the client accepts the applicability of the Terms and Conditions, unless Capsule Rent waives them in part or in whole in writing.
Should an individual provision of the Terms and Conditions be proven ineffective, this will not concern the binding nature of the rest of the provisions.
Special offers by the Capsule Rent are only binding after they are explicitly accepted by the client within a time period determined by us.

4. The Service
4.1. Rental
Capsule Rent rents clothing items and accessories, such as handbags, to clients for a selected time period. The day of delivery of the item counts as day 1 of the selected period.
The client receives the item in a ready-to-use state which is confirmed by the clean tag attached to the item.
The client must check the item upon its arrival. If no damages are reported to Capsule Rent 48 hours from the delivery, it is considered that the item was delivered in a ready-to-use state.
5. Account
The client must be 18 years or older to access or use the services. To use the services, you may be required to sign up for an account (your “Account”), select a password and username (your “Capsule Rent User ID”), and provide us with certain information or data, such as your contact information. Providing us with accurate, complete, and up-to-date information, and maintaining and updating such information is the client’s obligation.
Capsule Rent is free to suspend, limit, or terminate your access to or use of the services or your account, for any reason in our discretion, including your breach of these Terms.
6. Delivery and return
6.1. General
You are responsible for providing us with accurate shipping information for deliveries and for keeping the shipping information for your Account up-to-date so that we can timely deliver the selected items to you. If you provide us with a shipping address that is invalid or where you cannot securely accept the item upon delivery, or if you do not keep your shipping information up-to-date, you are solely responsible for any resulting loss, theft, or damage to the items. Following delivery to the designated address, as agreed between you and us, you will be solely responsible for the condition of each item until you return such item (including while they are in transit). We reserve the right to reject, cancel, or prohibit any rentals or sales of items for any reason.
Deliveries and returns are facilitated through the Austrian national postal service. Items are shipped within 3 working days of the date the order was made, starting the day after. Delivery time may vary and depends on the capacity of the delivery service.
The first day of the rental period is the date of the delivery. The client has to send the item back to Capsule Rent within 2 working days of the end of the rental period.
6.2.Return of rental
The client receives a return label by email 5 days before the end of the rental period, and again, 2 days before that said date. For earlier returns, the client must get in touch with Capsule Rent via email or phone.
Capsule Rent has 14 days from the date the item was returned for the performance of a quality check. Additional fees may fall if damages to the item become apparent during the quality check.
7. Cancellation and refund
The client may cancel the item prior it's shipping. A full refund is issued in this case.
If the item is returned within 14 days of the date the order was made on Capsule Rent website and the clean tag is still on, and the value of the order is over 50,00 EUR, a full refund is issued, including shipping costs.
For orders under 50,00 Euros, first-time refunds are refunded in full, if the clean tag is not removed and the item is shipped back within 3 days of the date of delivery. For further returns, the refund will be refunded as a credit for the next rentals.
If the clean tag has been removed, or there are traces from use, such as make-up marks, sweat stains, etc., the item is considered used and no refund is owed.
8. Legal right of withdrawal
For services/products purchased online, the client has the right, without giving a reason, to withdraw from the contract within 14 days of the conclusion of the said contract (i.e. the date of the order placement).
This right is waived, when the contract concerns services such as rental services and the company have already started delivering them. In that case, a withdrawal will result in a partial refund that corresponds with the percentage of the service being performed.
This provision is only applicable to orders which value is over 50,00 EUR. Orders under that amount are not subject of the right to withdrawal.
9. Cost of the ServicesAll prices of services and products provided by Capsule Rent are in accordance with our price list. The price list is part of these Terms.
The price of each item is listed on our website and it includes all applicable taxes. Cleaning and small repairs of the item are included in the price.
10. Payment
When you place a rental order for an item, you hereby authorize Capsule Rent to charge your payment card or other payment instruments (“Payment Method”) for the rental fee. Capsule Rent will charge your Payment Method the amount of the rental fee immediately upon your rental order.
Ensuring that the chosen Payment Method is at all times valid and up-to-date is the responsibility of the client. The client is also responsible for providing complete and accurate billing and contact information to Capsule Rent and notifying Capsule Rent of any changes to such information.
We use a third-party payment processor (the “payment processor”) to bill you for any paid services through a payment account linked to your account. By choosing to use paid services, you agree to pay us, through the payment processor, all charges at the prices then in effect for any use of such paid services in accordance with the applicable payment terms, and you authorize us, through the payment processor, to charge your chosen payment method.
We reserve the right to suspend or cancel a rental order or terminate your access to the Services in the event that we are unable to successfully charge the provided payment method. We are not responsible for errors by the payment processor, and we reserve the right to correct any errors or mistakes that we or the payment processor make(s) even if we have or our payment processor has already requested or received payment. If we, through the payment processor, do not receive payment from you, you agree to pay all amounts due on your billing account upon demand.
We use the following payment processors: Visa, MasterCard, PayPal.
11. Discount codes
Upon its own discretion, Capsule Rent may grant a client or/and group of clients a discount code, valid for a limited amount of time. Such discount codes only apply to the price of the service and not the shipping costs. The expiration date of the discount code and the amount of the reduction from the price are determined by Capsule Rent.
12. Cleaning
Cleaning the rented item after its ordinary use by the client is included in the rental fee. Any need for cleaning that exceeds this results in additional charges for the client. The amount of the charge is the amount paid by Capsule Rent to clean the item.
The item should not be cleaned by the client. However, if an emergency cleaning is needed, the client should follow the cleaning instructions on the item’s tag.
13. Repairs
Small repairs are included in the rental price. Every damage that exceeds the scope of a small repair result in an additional charge for the client. The amount of the charge is 70% of the retail price of the item.
14. Late Fees
If the client does not return the item on time, eg. after the rental period is expired, an additional fee of 15 euros a day is being charged for every day of the delay.
15. Use of the itemsThe client agrees to use the item in accordance with its ordinary use and may not let others use the rented item. The client agrees to pay the full retail price for all loss (including consequential loss) and damage caused by anyone in their party.
16. LiabilityIn the event of failure of service due to any acts or events beyond Capsule Rent’s control, including (but not limited to) death, illness, force majeure, breakdown, inclement weather, catastrophic loss of data or the failure to deliver goods and services provided by Capsule Rent’s or sub-contractors, Capsule Rent’s liability will be limited to the refund of any rental fees paid.
17. Governing Law
Any contract made between Capsule Rent and the client shall in all respects be governed by and construed in accordance with Austrian law and the parties hereto submit to jurisdiction of the Austrian courts.
